  • A refugee ( w:fi:pakolainen ) is a person who is outside their home country because they have suffered (or feared) persecution on account of race, religion, nationality, or political opinion; because they are a member of a persecuted social category of persons; or because they are fleeing a war. Kaikki kotimaastaan paenneet eivät ole pakolaisia. Jotta ihminen määriteltäisiin pakolaiseksi, hänelle on täytynyt myöntää pakolaisen asema eli pakolaisstatus.[3]
Pakolaisuutta koskee ja sitä määrittelee Geneven pakolaissopimus vuodelta 1951 ja sen pöytäkirja vuodelta 1967.[4]
Määritelmän mukaan eivät esimerkiksi sota, nälänhätä tai ympäristökatastrofi ole varsinaisesti pakolaiseksi oikeuttavia syitä. Mutta sen sijaan huoltajan puuttuminen; esimerkiksi orpous tai sotaorpous on. Yleissopimuksen mukaan pakolaista ei voida palauttaa maahan, jossa hänen henkeään tai vapauttaan uhataan. ( Wikipedia )
